1. Scope
1.1 These General Terms and Conditions (T&Cs) apply to all deliveries and services provided by VMAX Tools AG in the field of diamond tools and machines. By placing an order, you expressly agree to these T&Cs. They form an integral part of the contract between you and VMAX Tools AG.
1.2 Any differing terms of the customer will only be accepted if confirmed in writing by VMAX Tools AG.
2. Website information / Offers / Prices
2.1 VMAX Tools AG makes every effort to provide customers with the best possible information about the products offered (diamond tools and machines). The information on the website www.vmaxtools.ch is carefully compiled and is based in part on information from manufacturers and experts.
2.2 All information on www.vmaxtools.ch is provided without warranty. VMAX Tools AG accepts no liability for the accuracy, completeness or currency of the information.
2.3 Prices and the product range are subject to change at any time. Product images on the website are not binding and may differ from the actual product.
2.4 Current prices are published on the website www.vmaxtools.ch. All product prices displayed in the shop are in Swiss francs (CHF), excluding VAT and shipping costs. VAT is shown separately at checkout and added to the total amount.
3. Orders / Delivery
3.1 An order becomes binding when you click the "Complete order" button during checkout. You will receive an order confirmation by email.
3.2 VMAX Tools AG reserves the right to reject orders without giving reasons or to reduce the order quantity.
3.3 You are responsible for providing a complete and correct delivery address. If the information is incorrect, VMAX Tools AG accepts no liability for delivery delays or problems.
3.4 VMAX Tools AG delivers products within Switzerland. By placing an order, you confirm that you are at least 18 years old.
4. Delivery and delivery times
4.1 Where possible, delivery takes place within 1-3 working days after receipt of payment. Delays caused by third parties (e.g. shipping providers) may occur, for which VMAX Tools AG is not liable.
4.2 For products that are not in stock, delivery may be delayed depending on the manufacturer.
4.3 VMAX Tools AG is not liable for delivery delays caused by grossly negligent or intentional conduct by third parties or the customer.
5. Products delivered in error
5.1 Items delivered in error or in excess must be returned in their original packaging within 7 days.
6. Vouchers
6.1 Vouchers can only be redeemed once per order. The voucher value is deducted directly from the order total. Vouchers that exceed the order total cannot be refunded.
7. Shipping costs
7.1 Shipping costs for diamond tools and machines are CHF 18.00 for parcels up to 25 kg (max. 2.50 m combined length and girth). A shipping fee of CHF 80.00 (including VAT) is charged for a Euro pallet. These prices apply to A-Post or parcel services such as DHL, DPD or Planzer within Switzerland.
8. Warranty coverage
8.1 The statutory warranty of 12 months applies to machines. Diamond tools, accessories and spare parts are excluded from the warranty unless otherwise agreed.
8.2 Damage caused by improper handling, natural wear and tear or misuse is excluded from the warranty.
8.3 If the product is defective, you are entitled to repair, replacement or rescission of the contract.
9. Retention of title
9.1 The goods remain the property of VMAX Tools AG until payment has been made in full.
10. Duty to inspect and warranty
10.1 You must inspect the goods for defects immediately upon receipt and report any defects in writing within 3 days.
10.2 VMAX Tools AG accepts no liability for damage caused by improper use or external influences.
11. Returns
11.1 Products that are not defective may be returned within 3 days of receipt. Returns will only be accepted if the goods are unused and in their original packaging. You are responsible for return shipping costs.
12. Payment / Payment reminders / Retention of title
12.1 Orders are paid for by advance payment, credit card or invoice, unless otherwise agreed.
12.2 In the event of late payment, a reminder fee of up to CHF 20.00 will be charged. If the payment deadline is exceeded, VMAX Tools AG reserves the right to refer the outstanding amount to a debt collection agency.
13. Data protection
13.1 The data required to conduct business is treated confidentially and is stored and processed only for order processing purposes.
13.2 The data will not be shared with third parties without your express consent.
14. Liability
14.1 VMAX Tools AG is liable for damage caused by a grossly negligent or intentional breach of contract. VMAX Tools AG accepts no liability for indirect damage resulting from delayed deliveries or improper use.
15. Severability
15.1 If any provision of these T&Cs is invalid, the remainder of the contract remains valid. An invalid provision will be replaced by an economically effective provision.
16. Applicable law / Jurisdiction
16.1 Swiss law applies. The place of jurisdiction for all disputes is 4665 Oftringen (AG), Switzerland.
17. Changes to the Terms and Conditions
17.1 VMAX Tools AG reserves the right to change these T&Cs at any time. The current version is available on the website www.vmaxtools.ch.
